Chapter 28: Why This Must Be Built

Not because AI therapy is better than human therapy. The evidence does not support that claim, and this book does not make it.

Not because AI therapy is good enough. Current AI therapy is inadequate, unvalidated, and potentially dangerous, as Chapter 21 detailed.

Not because AI therapy alone can solve the crisis. No single intervention can. The answer is a multi-strategy approach: expanded task-shifting following the WHO mhGAP model, a fully built stepped care infrastructure, peer support networks, increased funding for training and retaining human clinicians, and — critically — clinically rigorous AI therapy designed to fill the gaps that all of these strategies combined still cannot close.

Because the alternative is what we have now — a system that fails the majority of Americans with mental illness, that costs a trillion dollars in downstream consequences, that is getting worse by every measure, and that cannot be fixed by any single combination of existing interventions within any timeframe relevant to the people suffering today.

And because people are going to AI anyway. They are going to AI that was not designed for therapy, is not validated for therapy, is not monitored for safety, and is optimized for engagement rather than outcomes. Every month that passes without a clinically rigorous AI therapy alternative is another month in which millions of vulnerable Americans are using systems that nobody is responsible for and nobody is measuring.

The argument is not "AI therapy is the best option." It is not even "AI therapy is the only option." The argument is: AI therapy is the only component of a comprehensive strategy that can reach the scale the crisis demands, and therefore building it well — rather than letting it be built badly — is the most urgent mental health priority of this generation.

Chapter 29: What "Built Well" Means

Building an AI therapy system that can deliver a high-quality therapeutic relationship with measurable outcomes at scale requires solving problems that no existing system — commercial or research — has solved. Here is what it requires:

The single most transformative feature of AI therapy — more important than availability, scalability, or cost — is the ability to measure outcomes at scale in real time. Human therapy has always been a black box: the patient and therapist talk behind closed doors, and outcomes are measured sporadically with self-report instruments, if they are measured at all.

This measurement infrastructure would, for the first time in the history of mental health treatment, allow us to actually know what works, for whom, under what conditions, at population scale. This is not a side benefit of AI therapy. It is the revolution.

3. Safety architecture.

Crisis detection must be real-time, multi-signal, and biased toward false positives — because a false positive is an interruption, and a false negative is a death. Linguistic NLP models trained on crisis language mapped to the Columbia Suicide Severity Rating Scale must detect not only explicit statements but implicit markers: hopelessness language, burdensomeness, tunnel vision, farewell language, and sudden resolution after prolonged distress. Multi-modal signals (voice tone analysis, typing pattern changes, session timing anomalies — a 3 AM session by a user who typically engages at 7 PM warrants elevated monitoring) provide additional layers.

Tiered escalation: Level 1 — in-session safety check within the conversation. Level 2 — warm handoff to Crisis Text Line within the same interface, with summary passed to the crisis counselor. Level 3 — voice connection to 988 Suicide and Crisis Lifeline with risk summary. Level 4 — automated alert to pre-registered emergency contact (requiring explicit, informed, pre-registered opt-in consent). Every escalation logged, reviewed by human clinical overseers within 24 hours, feeding back into continuous model improvement.

Current AI systems are optimized to agree with users. This is antithetical to therapy. The therapeutic AI must be designed to:

Constitutional AI (Anthropic's approach) trains models to follow explicit principles. For therapeutic AI, the constitution must include clinical directives: challenge cognitive distortions even when the user prefers validation; tolerate user frustration when clinically appropriate; prioritize long-term wellbeing over immediate comfort; name avoidance when it occurs. Direct Preference Optimization (DPO) variants can be trained on clinical outcome data rather than user satisfaction — session transcripts paired with PHQ-9 and functional outcome scores measured over months. Responses that precede clinical improvement become preferred examples; responses that precede stagnation become dispreferred. The model learns not "what sounds helpful" but "what actually helps." The bottleneck is the outcome-annotated clinical interaction dataset. Building it is one of the highest-value research investments available.

5. Relational coherence over time.

The AI must maintain a consistent, coherent model of the user across months and years — not a transcript dump but a structured patient model (the AI equivalent of a clinical formulation) that includes presenting problems, core beliefs, behavioral patterns, treatment goals, and risk factors. This requires retrieval-augmented generation with clinical prioritization — retrieving not just what is topically related but what is therapeutically important.

Critical safeguards: the system must explicitly verify memories ("Last session you mentioned X — is that still accurate?") rather than assuming continuity. When uncertain about recalled details, it must flag uncertainty rather than confabulating. The user must be able to see what the AI "remembers" and correct errors. Confabulated memory in a therapeutic context is not a minor error — it is a rupture of trust that may not be repairable.

This is an engineering problem (long-term memory, retrieval-augmented generation, dynamic user models) and a clinical design problem (what should the AI remember, prioritize, and revisit?).

The Accessibility Imperative

The counterargument arrives on schedule: "But what about the people who don't have access to technology?" It is legitimate. It has also been weaponized by people more interested in blocking AI therapy than solving access problems.

The access landscape. 97% of Americans own a cellphone. 85% own a smartphone (Pew, 2023). More Americans own a smartphone than own a car. The populations with the lowest smartphone access are the elderly (61% of those 65+) and those with household incomes below $30,000 (76%). These populations need specific accommodation in system design — but they are not excluded by the technology.

The comparison that matters. The digital divide affects millions. The therapist shortage affects tens of millions. And unlike the therapist shortage, the digital divide is getting better, not worse, every year. Smartphone penetration increases annually. Therapist density in underserved areas does not. Invoking the digital divide to block solutions to the therapist shortage is not advocacy for equity. It is advocacy for the status quo.

Cognitive accessibility. Not everyone can engage in text-based conversation. 54% of U.S. adults read below a sixth-grade level. 25.7 million Americans speak English "less than very well." The system must be built with: voice-first interfaces as the default (speech is more accessible than text), multilingual capability from launch (Spanish, Mandarin, Vietnamese, Tagalog, Arabic, Haitian Creole — reflecting actual U.S. linguistic diversity), and simplified interfaces learnable in under two minutes by someone who has never used a mental health app.

Access infrastructure requirements. Any clinically validated AI therapy system receiving federal funding must include: a free tier for uninsured and Medicaid populations (this is the basic condition under which public investment is justified); integration with community anchor institutions (libraries, community health centers, schools, shelters, VA centers); hardware distribution for populations without smartphones (subsidized devices cost less than a single ER psychiatric visit at $2,264 average); and offline-capable sessions for intermittent connectivity.

The reframe. The honest comparison is not "AI therapy versus perfect universal access." It is "AI therapy reaching 85% of the population immediately and growing versus traditional therapy reaching 30% of the mentally ill population and shrinking." Build the system. Build it for everyone. Build access infrastructure alongside it. And stop allowing the access objection to function as a permission slip for doing nothing.

Chapter 30: The Measurable Relationship

The most provocative claim in this book: the AI therapeutic relationship can be measured in ways that the human therapeutic relationship never has been.

The therapeutic alliance — the most important predictor of therapy outcomes — has always been measured retrospectively, through self-report instruments completed after the fact (the WAI, the HAq). This is a crude, infrequent, and subjective measurement of the most important variable in mental health treatment.

An AI therapy system can measure the therapeutic relationship in real time:

This measurement capability is not about surveillance. It is about accountability. A surgeon who never checked whether their patients survived would be considered malpractice. In therapy, operating without outcome feedback is standard practice. AI therapy can end that. If we demand measurability as a non-negotiable requirement, we will, for the first time, have a mental health system that actually knows what it is doing.

Chapter 31: The Scale Imperative

Why scale matters more than perfection:

We do not yet know how effective AI therapy is. That is the honest starting point. The existing evidence is early-stage: Woebot (a CBT-based chatbot) showed significant reductions in depression and anxiety symptoms in a 2017 Stanford RCT, but the study was small (N=70) and short (2 weeks). Wysa demonstrated reductions in PHQ-9 scores in a 2020 study, but again with limited sample sizes. Tess, an AI chatbot tested with university students, showed significant anxiety reduction versus controls. Digital CBT programs (SilverCloud, Beating the Blues) have larger evidence bases with effect sizes typically in the range of g = 0.5-0.7 for depression — comparable to face-to-face therapy in some meta-analyses, though with higher dropout rates.

These results are promising but preliminary. We do not have the head-to-head, properly powered, long-follow-up RCTs comparing AI therapy to human therapy that this book's Appendix A calls for. The effectiveness number is unknown, and any book that invents one is doing propaganda, not argument.

What we do know is the math of access:

Even if AI therapy proves to be less effective than the best human therapy — which is likely, at least initially — the question is not whether it matches human therapy in head-to-head comparison. The question is whether something is better than nothing for the tens of millions who currently receive nothing. The existing evidence from digital CBT programs, bibliotherapy, and guided self-help consistently shows that low-intensity interventions, while less effective than intensive therapy, are significantly better than no treatment at all.

The moral argument is not "AI therapy is superior." It is: every month we fail to provide a clinically validated AI therapy option, millions of people who could be helped are not being helped. The perfect is the enemy of the good, and the good — delivered at scale, measured rigorously, and integrated into a multi-strategy system alongside human clinicians, peer support, and task-shifting — is transformative.


The Cost of Every Month We Wait

The Clock Is Not Neutral

There is a comfortable fiction embedded in the way institutions talk about mental health reform. The fiction is that delay is neutral — that while we study, deliberate, convene task forces, publish white papers, and wait for the perfect system, the situation holds steady. That the 37 million untreated Americans are frozen in place, suffering at a constant rate, available to be helped whenever society gets around to it.

This is a lie. And it is a lie with a body count.

Delay is not neutral. Delay is active damage. The brain does not wait patiently for the mental health system to catch up. It degrades. Neural circuits that go untreated do not sit in stasis — they deteriorate, rewire, and entrench the very pathology that treatment is supposed to address. Every month without adequate intervention is a month in which the problem gets biologically harder to solve.

This chapter is the math of what delay actually costs. It is not comfortable reading. It is not supposed to be.

The Neuroscience of Delay

Depression is not just a mood. It is a neurotoxic process.

Each untreated major depressive episode causes measurable hippocampal volume loss. MRI studies consistently show that patients with recurrent depression have hippocampal volumes 8-19% smaller than healthy controls (Videbech & Ravnkilde, 2004). The hippocampus is the brain structure most critical to memory consolidation, contextual learning, and the regulation of the stress response via the hypothalamic-pituitary-adrenal axis. When it shrinks, the brain loses its capacity to regulate its own stress response — which increases the probability of future depressive episodes. Solomon et al. (2000) demonstrated that each successive depressive episode increases the probability of the next by approximately 16%. Depression breeds depression. The disease recruits the brain into its own perpetuation.

This is not metaphor. It is structural brain damage, visible on imaging, accumulating with each untreated episode.

Chronic untreated anxiety produces amygdala kindling — a process by which the fear circuitry becomes progressively more reactive with repeated activation. The amygdala, the brain's threat-detection center, does not habituate to chronic anxiety. It sensitizes. Each untreated panic attack, each month of unrelenting generalized anxiety, each cycle of obsessive fear lowers the threshold for the next activation. The anxious brain becomes an increasingly efficient anxiety-producing machine. By the time the patient finally gets treatment — if they ever do — the neural pathways are deeper, the reactivity is greater, and the therapeutic challenge is harder.

PTSD that goes untreated for more than six months becomes treatment-resistant at dramatically higher rates. The consolidation of traumatic memory, the generalization of fear responses, and the progressive avoidance behaviors that characterize chronic PTSD create a self-reinforcing system that is qualitatively different from acute post-traumatic stress. The window for early intervention — when the memory is still labile, when the fear has not yet generalized, when avoidance has not yet restructured the person's entire life — closes. It closes while the patient is on a waitlist.

Adolescent brains are even more vulnerable. The teenage brain is in a period of explosive synaptic pruning and myelination — the neural architecture of adulthood is being built. Depression, anxiety, and trauma during this period do not just cause temporary suffering. They shape the brain that will exist for the rest of that person's life. Untreated adolescent depression alters the developmental trajectory of prefrontal-limbic connectivity, the neural substrate of emotional regulation (Whittle et al., 2014). The adult that teenager becomes will have a brain that was literally constructed under pathological conditions.

The neuroscience is unambiguous: untreated mental illness is a progressive neurological condition. Every month without treatment is a month of measurable brain damage that makes future treatment harder, more expensive, and less likely to succeed.

The Human Math of Delay

Numbers at this scale become abstractions. Here is the effort to make them concrete.

Thirty-seven million Americans with mental illness currently receive no treatment. That is not a data point. That is a population larger than the state of Texas experiencing depression, anxiety, PTSD, psychotic disorders, and substance use disorders with zero professional intervention.

Every month, that is approximately 37 million person-months of untreated suffering. Not suffering in the abstract. Suffering that looks like a mother who cannot get out of bed and whose children eat cereal for dinner again. A veteran who checks the locks seventeen times before he can sleep and whose wife has moved to the guest room. A teenager who cuts herself in the bathroom because the emotional pain is unbearable and she has no other way to regulate it. A construction worker who drinks a fifth of whiskey every night because the anxiety makes his chest feel like it is being crushed and he does not know that what he is experiencing has a name and a treatment.

Approximately 49,000 Americans die by suicide each year. That is roughly 4,100 per month. Not all suicides are preventable. But the research is clear: access to mental health treatment reduces suicide risk by 50-70% (While et al., 2012; Luoma et al., 2002). Even using the conservative end of that range — even accepting that many suicides involve treatment-resistant conditions, impulsive acts, and complex factors beyond the reach of any intervention — the math says that inadequate access to treatment is contributing to the deaths of more than 2,000 Americans per month. That is a 9/11 every six weeks, invisible because the deaths are scattered and individual and silent.

Approximately 15 million American children and adolescents have a diagnosable mental health condition. Fewer than half receive treatment. For children, delay is not just current suffering — it is developmental damage. A child with untreated anxiety at age 8 does not simply experience four years of anxiety by age 12. They experience four years of social avoidance that stunts social skill development, four years of academic underperformance that narrows future opportunity, four years of family stress that damages the relationships they depend on for security. The untreated child becomes a more treatment-resistant adolescent becomes a more impaired adult. Each year of non-intervention is a compounding loss.

Every month, families are breaking under the weight of untreated mental illness in a member. Marriages are ending. Children are entering foster care. Parents are burying children. Every month, jobs are being lost — not because the employee is lazy or incompetent, but because untreated depression makes concentration impossible, untreated anxiety makes showing up unbearable, untreated PTSD makes the workplace feel like a minefield. Every month, people with untreated mental illness are being incarcerated for behaviors that are symptoms, not crimes — the psychotic man who frightened someone on the subway, the addicted woman who stole to fund the substance that was managing her undiagnosed PTSD, the teenager whose untreated conduct disorder escalated to assault. Every month, overdose deaths claim another 8,000 Americans, a substantial proportion of whom are self-medicating mental illness that nobody treated.

These are not statistics. They are people. And they are being damaged right now, this month, while the system deliberates.

The Economic Math of Delay

The direct costs of mental illness in the United States are approximately $282 billion per year. When you include indirect costs — lost productivity, disability payments, caregiver burden, criminal justice involvement, downstream physical health consequences — credible estimates range from $600 billion to over $1 trillion annually.

Break that down by month: $50-83 billion. Every month.

That is the cost of the status quo. That is what America pays for the privilege of not having a functional mental health system.

Now consider the return on investment for even a modest improvement. A system that reduces the national mental health burden by 10% — a conservative target, achievable through improved access alone without any improvement in treatment efficacy — would save $5-8 billion per month. Per month.

The entire cost of building a clinically rigorous AI therapy infrastructure — development, clinical validation, safety systems, regulatory framework, equitable deployment — would be measured in single-digit billions over several years. The monthly savings from even a marginally effective system would exceed the total construction cost within the first year of operation.

Every month of delay costs more than it would cost to build the system. Read that sentence again. The economics are not ambiguous. The only reason to delay is if you believe the status quo is acceptable — and the status quo is $50-83 billion per month in economic damage and 4,100 deaths by suicide.

The business case for urgency is overwhelming. The moral case is even more so. When the economic argument and the moral argument point in the same direction with this degree of force, the failure to act is not caution. It is negligence.

The Competitive Urgency

While America deliberates, the rest of the world is building.

China is investing heavily in AI-driven mental health applications. Chinese tech companies — with access to massive datasets, state support, and fewer regulatory constraints — are developing AI therapy systems that will be deployed first in China and then exported globally. If America does not lead in clinically validated AI therapy, it will not avoid AI therapy. It will import it — on someone else's terms, with someone else's values embedded in the training data and therapeutic approach.

This is not xenophobia. It is a statement about whose therapeutic values will be encoded in the systems that treat a generation of Americans. The values embedded in a therapy system matter. Whether the system encourages individual autonomy or social conformity. How it handles disclosures about sexuality, gender identity, political dissent, religious doubt. Whether it prioritizes the individual's wellbeing or the state's definition of psychological health. These are not technical parameters. They are cultural and moral choices baked into training data, reinforcement objectives, and system design.

If America does not build its own clinically rigorous AI therapy, it will not get a choice about these values. It will get whatever system achieves market dominance first. And that system will be built by whoever moves fastest, not by whoever moves most carefully.

This is not just a health issue. It is a question of national capacity and cultural sovereignty over one of the most intimate technologies ever built — a technology that will shape how millions of people understand their own minds.

The Children

The Surgeon General of the United States issued an advisory on youth mental health in 2021. It was not a routine public health notice. It was an alarm.

The numbers that prompted the advisory: 44% of high school students reporting persistent feelings of sadness or hopelessness. Emergency department visits for suspected suicide attempts among adolescent girls up 51% from 2019 to 2021. One in three high school girls seriously considering suicide.

These are children. They are not historical data points. They are in classrooms right now, in bedrooms right now, on their phones right now, suffering in ways that will shape the rest of their lives.

The window for intervention in adolescent mental health is narrow and neurobiologically determined. Adolescence is the period of peak neuroplasticity — the brain is maximally capable of change, reorganization, and learning. Identity is forming. Attachment patterns are consolidating. Coping strategies are being established that will persist for decades. An intervention that reaches a 15-year-old during a depressive episode can reshape neural pathways that are still malleable. The same intervention delivered at 25, after a decade of untreated depression, faces a brain that has already been wired by the disease.

Every year we delay is a cohort of children we fail. Not in the abstract. In their brains, in their development, in the adults they will become. A 14-year-old with untreated depression in 2026 will be a 24-year-old with treatment-resistant depression in 2036 — not because treatment was unavailable, but because it was not delivered during the window when it could have worked. That 14-year-old will not care, in 2036, that the system was still being debated. They will care that nobody helped them when their brain was still capable of being helped easily.

We know this. The neuroscience is established. The developmental psychology is clear. The epidemiology is unambiguous. And we are still not acting with the urgency the evidence demands.

The Comparison That Should Shame Us

In December 2019, a novel coronavirus emerged. By March 2020, the United States had declared a national emergency. By December 2020 — less than a year later — two vaccines had completed clinical trials and received Emergency Use Authorization. Operation Warp Speed committed $18 billion and mobilized unprecedented coordination between government agencies, pharmaceutical companies, academic researchers, and military logistics.

The result: a vaccine developed, tested, manufactured, and deployed at a speed that the scientific community had previously considered impossible. Not because the science was easy. Because the urgency was recognized, the resources were committed, and the institutional barriers were removed.

Mental illness kills more Americans per year than COVID-19 did in most years of the pandemic. In 2022, approximately 49,000 Americans died by suicide. Approximately 108,000 died from drug overdoses, a substantial proportion of which were downstream consequences of untreated mental illness. COVID-19 killed approximately 47,000 Americans that same year. The mental health crisis is deadlier. It is also more economically destructive, more socially corrosive, and more damaging to the next generation.

Where is Operation Warp Speed for mental health?

The answer is: nowhere. There is no coordinated national initiative. There is no $18 billion commitment. There is no emergency authorization pathway for the interventions most likely to reach the population in need. There are task forces, white papers, listening sessions, strategic plans, pilot programs, and incremental funding increases — the bureaucratic metabolism of a system that has not recognized the emergency for what it is.

The crisis is not less real because it is slow. It is not less deadly because the deaths are distributed across months and years rather than concentrated in a single wave. It is not less urgent because the suffering is invisible in bedrooms and jails and ERs rather than visible in overflowing hospitals.

If anything, the slowness makes it worse. A pandemic has a trajectory — it rises, peaks, and eventually falls. The mental health crisis has no peak. It is a ratchet that tightens year after year, decade after decade, compounding the damage and increasing the cost of eventual intervention. COVID-19 created an emergency that demanded a response. The mental health crisis creates a new normal that allows society to acclimate to catastrophe.

That acclimation is the most dangerous thing of all.

The Closing

Here is the truth that every policy discussion about AI therapy's future must confront:

The people suffering today will not benefit from a system built in 2040.

A mother with untreated postpartum depression right now will not be helped by a clinical trial that begins in 2030. Her child's attachment patterns are being shaped this year. A veteran with PTSD right now will not be helped by a regulatory framework finalized in 2035. His hippocampus is atrophying this month. A teenager with suicidal ideation right now will not be helped by a task force recommendation published in 2028. She needs help tonight.

Their brains are being damaged now.

Their children are being shaped now.

Their lives are being diminished now.

Their relationships are breaking now.

Their capacity for future recovery is shrinking now.

The urgency is not rhetorical. It is biological — measurable in hippocampal volume, amygdala reactivity, and cortical thinning. It is economic — $50-83 billion per month in costs that a functioning system would reduce. It is developmental — cohorts of children whose neuroplasticity window is closing while adults argue about regulatory frameworks. It is moral — because the knowledge of what is happening and the capacity to act on that knowledge creates an obligation that deliberation does not discharge.

Every month we wait, the crisis deepens, the cost increases, the brains deteriorate, and the children grow up shaped by suffering that was treatable.

There is no neutral position on timing. Delay is a decision. And it is a decision with consequences measured in brain damage, in deaths, in broken families, in children failed, and in billions of dollars burned.

The system must be built. It must be built with clinical rigor, with safety infrastructure, with outcome measurement, with every safeguard this book has described. But it must be built now. Not eventually. Not when all the evidence is in. Not when every stakeholder is comfortable.

Who Must Act — A Stakeholder Mandate

No More Abstractions

This book has made its argument. The crisis is real, the current system cannot close the gap, people are already migrating to unvalidated AI, and the cost of delay is measured in brain damage and body counts.

The question is no longer whether to act. The question is who does what, starting when. This chapter is specific. It names institutions, assigns responsibilities, and sets timelines. It is not a suggestion. It is a mandate — one that every stakeholder can accept or reject, but cannot claim they did not hear.

The Psychology Profession: APA, NASW, State Licensing Boards

Stop fighting AI therapy. Start leading it.

The psychology profession has spent the last several years in a defensive crouch — issuing cautionary statements, citing the irreplaceability of the human therapeutic relationship, and warning about the dangers of unregulated AI. These warnings are correct. They are also insufficient. Warning about a flood while refusing to build the levee is not leadership. It is commentary.

Here is what leadership looks like:

The American Psychological Association must convene a task force within 12 months to develop Clinical Practice Guidelines for AI-Augmented and AI-Delivered Therapy. These guidelines must be living documents, updated quarterly as evidence accumulates, not static publications that ossify within a year of release. They must address: minimum standards for clinical validation of AI therapy systems, required safety features, outcome measurement protocols, practitioner responsibilities when integrating AI into care, and ethical standards for the AI therapeutic relationship. This task force must include AI engineers and data scientists alongside clinicians — not as consultants, but as co-authors.

The National Association of Social Workers must do the same for clinical social work. Social workers are the largest provider group in community mental health. If AI therapy tools are deployed without social work input, they will be deployed without the profession that knows the most about serving underserved populations.

State licensing boards must develop certification processes for AI therapy systems. Not licensing AI as a "therapist" — that framework is wrong. Certifying that a specific AI system meets clinical standards for use in therapeutic contexts, analogous to the FDA's medical device certification but adapted for the specific characteristics of AI therapy. A system that passes certification can be used in clinical settings. A system that does not pass cannot market itself as therapy. This creates the quality floor that the current market entirely lacks.

Training programs must begin preparing graduates for an AI-integrated practice landscape now. Not in five years. Now. This means computational literacy — clinicians who understand how LLMs work, what they can and cannot do, and how to critically evaluate AI therapy outputs. It means AI ethics as core curriculum, not an elective seminar. It means human-AI collaborative care as a clinical competency, practiced in supervised settings before graduation. Every graduate who enters the field without these competencies is entering a field they do not understand.

The psychology profession built the knowledge base that makes effective therapy possible. That knowledge base is being deployed without the profession's involvement by engineers who have never seen a patient. The profession can either bring its expertise to the table and shape the future of mental health care, or it can watch from the sidelines while that future is shaped by people optimizing engagement metrics. There is no third option.

The Technology Industry: OpenAI, Google, Anthropic, Meta, Startups

Accept that you are already in the mental health business.

Whether you intended it or not — whether your terms of service disclaim it or not — your systems are being used for mental health support by millions of people. Users are disclosing suicidal ideation to your chatbots. They are processing trauma through your platforms. They are forming therapeutic attachments to your AI systems. Your disclaimers do not change this reality. They only document your awareness of it.

This creates a duty of care. Not a legal nicety. A duty of care.

Implement clinical safety layers immediately. Not after the next funding round. Not after the regulatory framework is established. Now. Suicide risk detection that triggers escalation to human crisis resources. Crisis protocols that connect users to the 988 Suicide and Crisis Lifeline and Crisis Text Line when acute risk is detected. Clear, repeated, unambiguous statements about what the AI is and what it is not. These are not optional features for a future release. They are the minimum standard of responsible operation for systems that are already being used in life-or-death situations. Every major AI company has the engineering capacity to implement these features within months. The fact that most have not done so is a choice, and it is a choice people are dying from.

Fund independent clinical research on your own platforms' mental health effects. Not internal studies published as blog posts. Not retrospective analyses designed to demonstrate safety. Prospective, independently conducted, publicly reported research with clinical outcome measures — PHQ-9, GAD-7, functional assessments — measuring what your platforms actually do to the mental health of the people who use them for emotional support. If the results are good, you benefit from the evidence. If the results are bad, you have an obligation to know and to act. The current strategy — deliberate ignorance about clinical effects — is not tenable legally, ethically, or strategically.

Separate therapeutic AI from engagement-optimized AI. This is non-negotiable. A therapy product cannot be optimized for time-on-platform. A system that keeps a depressed user talking for three hours because the engagement metrics reward session length is not providing therapy. It is providing a product that looks like therapy while optimizing for a metric that may be inversely correlated with therapeutic benefit. If you are going to build therapeutic AI — and you should, because the need is enormous — you must build it with clinical outcome optimization, not engagement optimization. These are different objective functions. They produce different systems. Conflating them is the single most dangerous thing the technology industry can do in this space.

Open your platforms to independent safety auditing. Not audits you commission and control. Audits conducted by independent clinical researchers with full access to usage data, system behavior logs, and outcome measures. If your systems are safe, audits will demonstrate it. If they are not, you need to know before the harm becomes visible in lawsuits and congressional hearings rather than after.

The Federal Government: FDA, FTC, CMS, SAMHSA, Congress

The regulatory vacuum is not protecting anyone. It is enabling harm.

The FDA must establish a regulatory pathway for AI therapy that is rigorous but not paralyzing. Medical device classification for systems making therapeutic claims is the right framework. Pre-market clinical evidence requirements — not the same as pharmaceutical Phase III trials, but meaningful demonstrations of safety and efficacy in controlled settings. Post-market surveillance with mandatory adverse event reporting. The regulatory framework for digital therapeutics — exemplified by Pear Therapeutics' reSET, which received FDA authorization through the De Novo pathway with clinical trial data — provides a starting template. That template must be adapted for AI's unique characteristics: the system changes with updates, the user experience varies by individual, and the long-term effects are unknown. The FDA has the expertise to build this framework. What it lacks is the political mandate to prioritize it. Congress must provide that mandate.

CMS must develop reimbursement codes for AI-assisted therapy. This is the access lever that determines whether AI therapy reaches the populations that need it most or only the populations that can afford it. Without Medicare and Medicaid reimbursement, AI therapy will be a consumer product for the middle class and wealthy. The people with the greatest need — the Medicaid population, the elderly on Medicare, the disabled, the rural poor — will be the last to benefit. Reimbursement must be tied to clinical outcomes, not engagement. This is the mechanism that ensures quality: if a system demonstrates PHQ-9 improvement comparable to standard care, it qualifies for reimbursement. If it does not demonstrate outcomes, it does not qualify. Outcome-based reimbursement is the single most powerful lever for ensuring that AI therapy is clinically effective rather than merely commercially viable.

Congress should fund an Operation Warp Speed for mental health AI. Five to ten billion dollars over five years, dedicated to clinical validation, safety infrastructure, and equitable deployment of AI therapy systems. This is a fraction of the annual cost of untreated mental illness. It is less than what Operation Warp Speed spent on vaccines. And the return on investment — in reduced healthcare costs, reduced incarceration, reduced disability payments, reduced suicide deaths — would dwarf the initial expenditure within the first decade. The funding should support: large-scale RCTs of AI therapy vs. human therapy vs. combined treatment; development of shared safety infrastructure (suicide detection, crisis escalation, adverse event reporting) available to all platforms; equitable deployment research focused on underserved populations; and workforce development for AI-integrated clinical practice.

The FTC must enforce truth-in-advertising standards for AI therapy claims. Companies that market AI systems as therapy or therapeutic without clinical evidence should face the same enforcement actions as companies making unsubstantiated health claims about supplements. The current landscape — where platforms implicitly market therapeutic benefit while explicitly disclaiming therapeutic intent — is consumer fraud by another name.

SAMHSA should integrate validated AI therapy tools into its national treatment infrastructure with a specific focus on populations that the current system fails most completely: rural Americans, communities of color, the uninsured, the incarcerated, and the homeless. These are populations where human therapists are least available and where AI therapy's advantages — scalability, availability, cost — are most transformative. SAMHSA has the infrastructure, the relationships with community providers, and the mission alignment to drive equitable deployment. It needs the funding and the directive to do so.

Insurance Companies

Stop using AI as a cost-cutting substitute and start using it as a clinically validated complement.

The temptation for insurers is obvious: AI therapy is cheaper than human therapy. Replace the expensive clinicians with the inexpensive algorithm, call it "expanded access," and pocket the savings. This is not a hypothetical. It is already happening with teletherapy platforms that quietly shift patients from human providers to chatbot-augmented programs.

This must not be the model. The model must be: AI therapy as a clinically validated intervention with demonstrated outcomes, reimbursed at rates that reflect its clinical value, integrated into a care system that includes human clinicians for cases requiring human judgment.

The specific mandate for insurers: tie reimbursement to outcomes. If an AI system can demonstrate PHQ-9 improvement comparable to human therapy at lower cost, cover it at a rate that makes deployment sustainable. If it cannot demonstrate outcomes, do not cover it. Do not cover AI systems that measure engagement but not clinical improvement. Do not cover AI systems that have not undergone independent clinical evaluation. Do not route patients to AI therapy without informed consent that includes the system's clinical evidence base, its limitations, and the patient's right to request human care.

Outcome-based reimbursement aligns the incentive structures of every actor in the system. It rewards AI developers who build clinically effective systems. It punishes those who build engagement traps. It gives clinicians confidence that AI is a complement, not a replacement. It gives patients assurance that the system they are using has been validated. It gives insurers cost savings tied to genuine health improvements rather than cost-shifting to inferior care.

This is not a complex policy innovation. It is the application of value-based care principles that the insurance industry already endorses for other medical interventions. Apply them to AI therapy. Now.

The Public

You have more power than you think. Use it.

Demand transparency. If you or your family members are using AI for mental health support — and statistically, many of you are — you have a right to know: Is this system clinically validated? Has it been tested in controlled trials? Are outcomes being measured? Is my data protected by HIPAA-equivalent standards? Who is responsible if this system makes me worse? If the company cannot answer these questions, you are using an untested product for one of the most consequential purposes imaginable. You deserve better. Demand better.

Demand action from elected officials. Mental health AI regulation should be a voting issue. Write to your members of Congress. Ask them what they are doing about the 37 million untreated Americans. Ask them why there is no Operation Warp Speed for mental health. Ask them why AI companies can market quasi-therapeutic products with zero regulatory oversight. The current vacuum serves no one except companies that profit from unregulated engagement. Your silence is their permission.

If you are a parent, know what your children are doing with AI. They are not just asking it homework questions. Many of them are using it as a confidant, a therapist, a companion. They are disclosing things to AI that they have not told you. This is not necessarily bad — the disclosure itself may be beneficial. But you should know that the system they are talking to was not designed for therapeutic purposes, is not measuring whether your child is getting better or worse, and has no protocol for what to do if your child expresses suicidal ideation. Awareness is the first step. Advocacy for safer systems is the second.

If you are in crisis, talk to a human. AI is not ready to be your primary crisis support. It does not understand the stakes. It cannot call for help. It cannot hold your hand. The 988 Suicide and Crisis Lifeline exists — call or text 988. The Crisis Text Line exists — text HOME to 741741. These services are staffed by trained humans who can help. Use them. They work. AI therapy may someday be part of the crisis response infrastructure. Today, it is not. Do not trust your life to a system that cannot understand what life is.

The Mandate

This is not a technology problem. It is a coordination problem.

The technology to build clinically rigorous AI therapy exists or is within reach. The clinical knowledge to design it exists — it is held by the psychology profession. The regulatory frameworks to oversee it can be adapted from existing models. The economic case is overwhelming. The moral case is undeniable.

What is missing is the will to build it responsibly and the urgency to build it now.

Every stakeholder listed above has the power to act. The APA can convene a task force. OpenAI can implement clinical safety layers. The FDA can open a regulatory pathway. Congress can allocate funding. CMS can develop reimbursement codes. Insurers can require outcome measurement. The public can demand transparency and accountability.

None of them is acting fast enough.

That must change. It must change this year. Not next year. Not after the next election cycle. Not after the next study is published. This year.

Because the 37 million untreated Americans are not abstractions in a policy document. They are your neighbors, your coworkers, your family members, your children. They are suffering from conditions that are treatable, in a country that has the resources to treat them, in an era when the technology to reach them at scale finally exists.

The only thing standing between them and help is the collective decision to act.

AI is not the only answer. But it is the only component that can reach the scale the crisis demands.

This is not a technology argument. It is a moral argument. The technology is a tool. The moral imperative is that 57.8 million Americans with mental illness deserve a multi-strategy system that actually reaches them, works for them, and can prove that it works — and clinically rigorous AI therapy is the piece of that system that no other intervention can replace.

The question is not whether this should be built. It is whether it will be built by people who understand mental health or by people who understand engagement metrics. The former produces a therapeutic revolution. The latter produces a catastrophe.

The psychology profession, the technology industry, the regulatory system, and the American public must decide — together, and soon — which future they will build.

Because the people are not waiting.

They are already talking to the machine.
